While not alone in doing so, the influential Roman orator and statesman Marcus Tullius Cicero (106–43 BC), contributed much to the canon of thought that went through into the Middle Ages. He insisted that any declaration of war was made by a legitimate authority, partly because this was essential to the legal status of the procedure, and partly as a way of minimising the potential for civil wars. 12 While not necessarily found in the legal formalities of the procedure, Cicero made it clear that even wars fought for glory must be motivated by this desire to live in peace and be prosecuted with less brutality than wars fought for the very survival of the state.
